Unknown-444THE PUPPET MASTER

Does the famiglia buy loyalty in the realms of the press?  The County lists it’s legal filings with the Press Enterprise (PE) – which of course, keeps ‘em afloat money-wise.  The County could use other newspapers – most in the County – even the little one’s are certified by the court for legal filings.  But the county pays the PE (sometimes 3 times the cost) the high end legal “ad’s” pricing.  Many of these little local “rags” charge a third of what the PE charges.  Could it be that John Tavaglione (JT) buys loyalty?….Is Tavaglione behind the PE not hitting hard, with reference to media events?  Could this scenario explain how he’s protecting his boy Mayor Bailey?  Mayor Bailey being a former staffer of John Tavaglione, and interesting enough, also worked for Congressman Ken Calvert, who didn’t hold back when it came to his voracious appetite for female street walkers.  Rumors in the grapevine continue to connect Calvert with local hotels and hookers.  Don’t quote me on that, these are alleged rumors.  Of course, Calvert and Tavaglione are friends.

These two have been seen associating with Western Municipal Water Board of Director, Don Galleano and of course Riverside’s own, Councilman Steve Adams in many local watering holes.  The “dangerous liaisons” appear publicly clear, but what does this all mean?

Well, first, it is no surprise that Riverside County Supervisors support Councilman Adam’s run for Congress, and of course, Michael Williams directing his fundraising campaign.  But why is that?  Councilman Adams has the most ethics complaints filed against him, but of course through a Council admitted flawed process, appears to always result in a favorable outcome.  But when you view the network of individuals involved in the political process or, as I call it, the “Machine,”  it is no surprise that Riverside County Supervisors support Councilman Adam’s run for Congress.

So what is the connection or relationship between the PE and the City of Riverside?  We do know they received preferential electric rates at one time.  Would this be a gift of public funds since the residents of Riverside had to pay more for electricity of a utility they publicly own?  So,  if Adams is seen conversing with Ronald Redfern , former CEO and Publisher of the Press Enterprise, what kind of message does this send to his community?  Or could this be construed as meaning anything when it came to City politics?  We give you this recent political article by non other than Councilman Steve Adams in the PE.  Is the fact that this article received exposure in the PE directly due with who you know?  Is this a free campaign ad given to Steve?  Why is Steve on board with the PE as a contributing writer?  The County of Riverside under the direction of Tavaglione purchased the Press Enterprise building…coincidence?  Former PE CEO and Publisher Ronald Redfern is incidentally now Chairman of the Board for the Greater Riverside Chamber of Commerce.  We also see that Cindy Roth is involved, who’s husband is now Congressman Senator Roth, who did outside legal work for the City of Riverside..  and of course, Roth’s legal work never directly impacted the taxpayer’s with a positive benefit!   Not surprising..  But what was Cindy Roth’s position of going to each council member to, as Rodney King would say, “Can’t we just get along..” when tension escalated with council members.  Who is Cindy Roth and why doe she appear to have some sort of influence on elected officials?  Was she worried about her taxpayer handout?

Untitled-2

I think John Tavaglione is the reason behind the PE not hitting hard on issues that are important to the community.  His connection to the PE is uncanny.  Is he’s protecting his Boy Bailey (the current Mayor, William Rusty Bailey) – no doubt in my mind.  The PE appears to cave to the supes – especially when we know that JT is the “leader” of the Supes.  We must not forget the Inland Empire Political Fundraiser Icon, Michael Williams – often referred to as the only real game in town, is an ally of JT.  It has been purported that Tavaglione owns the building that Williams  resides and rents office space from.  Would that be some sort of red flag?  I would think so. So if John Tavaglione does not approve of a candidate or a particular measure, can we say that Mike won’t do the political fundraising?  If this is true, does someone have to kiss the “Godfather’s” ring to get approval and show ones loyalty?  The Michael Williams Company client list appears to be quite telling.  Made up of the “usual suspects” with a particular commonality.  Not hard to see a diffused political leaning as we would imagine.

What causes the political chaos or the stagnation of someone attempting to do good for the community?  Would it be who you know?  Has one person become so powerful that one nervously jumps at the drop of a pen when asked to do a favor?  A possible favor to maintain status quo?  Of course, in the sense of JT’s boy Bailey the appearance of not being status qou would not be acceptable..
(RPOA) Riverside Police Officer’s Association,  President Brian Smith is a friend of John Tavaglione.  He who controls RPOA campaign funds, as Smith – can often control some Council Members, as what we have seen with such graduates of RPOA in Riverside, as Chris Lanzillo.   The “control” has been seen in the “Soubirous Hearing.”  .. known as “The Soubirous Hearing Debacle,” that Smith was a part of.  But the whole agenda just appeared to “blow back” on their original plan.  Was this all about the “Cop Play Book?”   Further, JT also toppled longtime Riverside Sheriff’s Association (RSA) President Pat McNamara.  Former County Supervisor Bob Buster one stated, “RSA is the single biggest political force in Riverside County.”  Well, not anymore. RSA President Robert Masson, supported by Big John, toppled McNamara two years ago and now controls the very large PAC fund built up during the McNamara years.  Since John Tavaglione (JT) controls Masson, he now controls the RSA Political Action Committee. The PAC funds are rumored to be half a million or more. Big money – huge control. Val Hill, who claims to be a good friend of JT, reportedly was recruited by him to run for Riverside City Council last year.  Let’s see, RPOA (strongly influenced by JT) supported a longtime friend of JT – she certainly would have fully supported Bailey and company.
From a residents point of view Val Hill certainly didn’t appear to know the issues, well to put it bluntly, didn’t really know jack shit!  Not to mention the shit load of money to support her campaign that didn’t pan out except for the broken sewer pipes.  So, JT, a County supe, strongly influenced Brad Hudson, who was a former County Employee prior to moving over to Riverside City.  His “mini-me” DeSantis, came from the County as well.  And we know Priamos needed an “exit stage left” when the poop hit the fan over the Soubirious “investigation” flop, and had a soft landing with a County job.  All John Tavaglione?…. I would bet on it!  If this is all true or somewhat true, how could John became so powerful as a simple public servant?  Is he really there to represent the taxpayer?  Or does his organizations true objective lie elsewhere?  Benefiting ….  ?

CITY OF RIVERSIDE: COUNCILMAN STEVE ADAMS TAKES THE CAKE WHEN IT COMES TO ETHICS COMPLAINTS! WHAT! HE IS RUNNING FOR CONGRESS?  THE US CONGRESS?  In a recent PE article Councilman Steve Adams stated that “This system is broken and it’s unfair,” Councilman Steve Adams said. “I don’t think we have the transparency that we need.”  But, but in one of these complaint Steve stated that he saw corruption, not once, but two times!  It appears that the Ethics and Complaint process that was set up, designed and crafted by former City Attorney Greg Priamos has been brought to the fore front.  It appears that he skipped town just in time to work for the County Supes… Steve takes the cake as the most Ethics Complaints which have been brought against a Councilman in the City of Riverside..and were unfounded! So the question is, did he or didn’t he see corruption in the City of Riverside?  We think he did..and the Ethics and Conduct process was set up for Stevo and his episodes, to be mitigated to a position of non compliance.

Great work justice league! I know who John Aki is and in my estimation he has always been a straight up guy. I wish the best for him in his lawsuit. I will post his lawsuit and details. Thanks again for your insight and information. Agreed..why this news isn’t in the Press Enterprise, I just cannot understand. It may be why they blocked me from commenting, but their are many more who have contacted me complaining about being blocked by the Press Enterprise. Is the Press Enterprise a real newspaper? Or is it bought and paid for as many politicians are? I believe the next posting may have some answers. I look forward to your comments.  – Thirty Miles

ASSISTANT CITY MANAGER, BELINDA GRAHAM TAKING CONTROL.. yes it appears she searching Las Vegas on her City screen..

According to a Press Enterprise story on December 24, 2013, Assistant City Manager Belinda Graham again signed on the Rancho Cucamonga law firm Cihigoyenetche, Grossberg & Clouse to again investigate another alleged wrongdoing case for the City of Riverside.  This time they were again hired to investigate themselves, this time RPD’s asset forfeiture expenditures.

According to Vivian Moreno, her account and comment on this situation are as follows:

Does the misuse of assett forfeiture funds turn cops into robbers?  Equitable Shared Funds (Asset Forfeiture Funds) shall be used by law enforcement agencies for law enforcement purposes. Here are some of the “ALMOST NOTHING” things that were spent.  Baker to Vegas Run-tennis shoes, gear & hotel stay. Police Chief Leach paid $35K to his wife Connie.  Birthday cake and candles. Police Chief Leach & Gonzales spent almost  $500 a night each at the Ritz Carlton, Vicino goes golfing.  Police Chief Leach took Grover Trask to lunch with these funds, then the City of Riverside hired Grover to defend Leach.  I bet Grover didn’t know leach was using Asset Forfeiture Funds to pay for his lunch.  Or the $15,000 on Fitness Equipment, $2,084.40 on Small Kitchen Appliances or the $35,000 to former Police Chief Russ Leach’s wife Connie Leach’s Multi Cultural Youth Festival?  Assistant Finance Director for the City of Riverside tried to explain it to Dvonne Pitruzzello, but again the DOJ has precise criteria for the use of asset forfeiture funds.  One thing is certain, you cannot transfer Federal Police Asset Forfeiture monies to the General Fund.

According to a recent Press-Enterprise review of asset forfeiture spending, they turned up almost nothing that appeared to be questionable.  Are you kidding?  Do you even know what Equitable Sharing is?  Here is a link of equitable sharing guideline by the DOJ.  Read this first, then do you review.  My second question is how much time did you spend on your review to find almost nothing?

Asset Forfeiture Guide: Seeks to assist state and local law enforcement agencies participating in the program by clarifying the directives they must follow to obtain and use equitably shared funds.  The goal is to make the process as clear as possible so that local communities and the nation can thrive from reduced crime and from quality law enforcement.  Were suppose to use bad guy’s monies against bad guy’s.  Who’s the bad guys in Riverside?

Equitably Shared Funds shall be used by law enforcement agencies for law enforcement purposes only.  What does Tennis Shoes, Lunches, Connie Leach and Golf have to do with Law enforcement?  I trust Aquino’s account of the situation than the City’s.  She understands the program even better than the Press Enterprise.

If the Press Enterprise turned up “almost nothing,”  that means they turned up something.  So what was it?  What may seem slight to the PE, may be huge to the Attorney General.  Communities have lost Asset Forfeiture Funds for almost nothing.  Here is a link with 14 ridiculous things police bought with Assett Forfeiture Funds.  Which includes law enforcement agencies who have spent $10,000 for gatorade to $25,000 for Disney training.  The following is former Chief Russ Leach uniform bill and lunch with former DA Rod Pacheco paid by police asset forfeiture.

Then you have to ask the question, “Did the Chief Diaz cancel the current December “Chief’s advisory Board Meeting” because they could no longer use Police Asset Forfeiture funds to pay for the dinner provided to the Board Members?”   What fund will they use now and will there be a January meeting with no food?   I just have one thing to say to the CHIEF… POT LUCK!

If you remember back in March 2011, TMC did a story regarding forming Deputy City Attorney Raychele Sterling’s allegation of that former City Manager Brad Hudson was allegedley steering contracts to his friends.

BRAD2 copyFormer City Manager Brad Hudson

Sterling learned this from emails sent from employees in the Public Works Department.  Ms. Sterling reported these allegations of favoritism to the City Council Members and Superiors, and was then fired by her boss, City Attorney Greg Priamos.  City officials then said the allegations of contract steering were baseless, the City Attorney never responded and City Manger Hudson hired the above firm to investigate himself and put to put to rest these allegations against him.  We’ve yet to hear a response from her current boss, City Manager Scott Barber on this issue.

06clapper-articleInline                                               sb

City Manager Scott Barber                         Ooops, Sorry, City Manager Scott Barber

The law firm will charge the taxpayer a measley $300.00 plus incidentals.  After $150,000.00, the law firm miraculously concluded the allegations were baseless!  What a miracle.  Belinda Graham was also assistant city manager under Hudson.  We as taxpayers must begin to ask the City why it has costed us so much liability, not this one case, but other, especially the ones you don’t hear about.  The new investigation is all about Police Asset Forfeiture expenditures.  The way these funds are spent are in question.  The criteria for spending is set by the Department of Justice.  According to the Press Enterprise, the PE themselves did their own investigation and found in a review of asset forfeiture spending by RPD, they concluded they turned up almost nothing that appeared questionable.  Really now PE?  Running shoes, Las Vegas to Baker Run, Connie Leach salary not questionable?  What the PE doesn’t understand is that items which appear as nothing can consequentionally be a basis for losing the whole assett forfeiture program in Riverside.

Magic%20Castle%20Lecture

NOW YOU SEE IT, NOW YOU DON’T!  IS THIS WHAT THE TAXPAYER SHOULD EXPECT FROM THE NEW INVESTIGATION?

Partner Scott Grossberg of the law firm Cihigoyenetche Grossberg Clouse

The story gets stranger, because TMC found out later that one of the partners of the law firm, Scott Grossberg, also a motivational speaker who specializes in magic,  and is the author of three critically acclaimed and bestselling books, available on Amazon, “The Vitruvian Square: A Handbook of Divination Discoveries,” “The Masks of Tarot,” and “Bauta: Betraying the Face of Illusion,” in addition to his oracle/divination cards, “The Deck of Shadows.”

This partner specializes in magic, thought-reading, and divination (Tarot, oracle cards, palmistry, astrology, and numerology).  How much will this investigation cost the taxpayer this time, I guess my question to the City of Riverside is, does this get paid through the taxpayer or the other side.  But it may be as it is in Belinda’s world, Cihigoyenetche Grossberg Clouse may be just the thing to take this investigation that one step beyond.

HERE’S THE ORIGINAL TMC STORY ABOUT THE WHOLE INCIDENT OF ALLEGED CONTRACT STEERING AND FIRING OF FORMER DEPUTY CITY ATTORNEY RAYCHELE STERLING.

ROUND THREE APPEAL FOR FORMER AND FIRED CITY EMPLOYEE JASON HUNTER

round-3

In a letter, appellant Jason Hunter, former City of Riverside employee,  questioned the decision of the Code of Ethics Adjudicating Body made on his behalf.  TMC recently wrote about this in this December 2013 article.  Jason Hunter was the City of Riverside’s Principal Resource Analyst, in other words his was head of Wholesale Energy Marketing and Trading.  Hunter’s recent letter is as follows:

Appeal by Jason E. Hunter of Code of Ethics Adjudicating Body Decision of Code of Ethics and Conduct Complaint against the Human Resources Board

In accordance with the City of Riverside Resolution No. 22461-Code of Ethics and Conduct -the following shall serve as a formal appeal of the Adjudicating Body’s decision regarding the above-referenced ethics complaint, filed September 9,2013, and heard on November 15, 2013, and December13, 2013.  It is appellant’s contention that the findings and conclusion of the Adjudicating Body weremade in clear error and abuse of discretion.

As to the first cause, Creating Trust of Local Government:

The Adjudicating Body (“AB”) ignored the fact that the members of the Human Resources Board (“HRB”), serving as a quasi-judicial panel, had a serious obligation to appellant to understand the basic tenets of local, State, and U.S. law regarding due process and disciplinary proceeding procedures. The AB found that the HRB was unprepared for this hearing, and delegated its responsibilities to an all-too-ready-to-take-charge City Attorney, but instead placed this blame on city staff. While appellant agrees there is significant fault on behalf of staff, he believes the HRB also had a fiduciary duty to him to make sure he was afforded a fair hearing by an impartial tribune. It is clear from the videotape of the disciplinary hearing that the appellant believed there were clear violations of his rights taking place, and yet these are never even minutely addressed by the HRB.

The Adjudicating Body did not consider the fact that all post-hearing attempts to cure the defects presented to the HRB after the May 13, 2013, hearing, including his Motion for Reconsideration of June3, 2013; letter to HRB Chairman Powell of May 16, 2013; and additional pleadings at subsequent HRB open hearings were simply ignored. The AB also chose to ignore Section 804 of the City Charter stating that Boards must meet monthly, so that the public has an adequate opportunity to voice its concerns regarding city operations.

As to the second cause, Making Unbiased, Fair, and Honest Decisions:

The Adjudicating Body admits the City Attorney took over the meeting at times. The Adjudicating Body recognizes the HRB was not prepared for the disciplinary hearing. Given these two admissions, how can the HRB have made fair, unbiased decisions?

As to the third cause, Treating Everyone with Respect and in a Just and Fair Manner:

The AB admits the HRB and city were remiss in providing transparent and easily comprehended protocols, rules, and outline in a timely fashion to the appellant. The AB seemed to ignore that the advocating Deputy City Attorney seemed well prepared for his disciplinary hearing in terms of time limits the appellant was ignorant to. Hence, the City Attorney’s office seemed to receive preferential treatment in preparation for the disciplinary hearing.

The AB admits procedural defects most likely happened during the course of the disciplinary hearing, but does believe the HRB had a responsible to at least slow down the proceedings to investigate the appellant’s claims of such. Appellant finds this logic flawed.

As to the fourth cause, Ensuring that all Public Decisions are Well Informed, Independent, and in the Best Interests of the City of Riverside:

The Deputy City Attorney misled the AB at the December hearing by stating the HRB does not have the power to compel testimony nor evidence. This statement is a half-truth, nor was this assertion what appellant stated for the record at his disciplinary hearing. City Charter section 804 grants the HRB the option of requesting such power from the City Council, as would have been appropriate in an adversarial proceeding of substantial concern such as appellant’s demotion and termination under circumstances of alleged retaliation and harassment.

As far as protecting the best interests ofthe City of Riverside, the appellant leaves to the City Council to decide whether allowing a contested disciplinary hearing to spiral into Superior Court and the District Attorney’s office was good judgment.

As to the fifth cause, Ensuring that All Officials are Prepared for the Exercise of Their Duties:

The AB acknowledges the HRB was unprepared for the disciplinary hearing, and delegated decision making to the City Attorney’s office in light of their willful ignorance. However, the AB seems to find city staff at blame. Appellant argues once again that the HRB was cognizant of the significance of this disciplinary hearing and chose to willfully come unprepared to conduct this quasi-judicial session.

Appellant in fact believes the rules, protocols, and outline for his disciplinary hearing were not even written by the HRB, which should have been their responsibility to deliberate publicly. Hence, the HRB allowed themselves to be beholden to a biased City Attorney’s office in how it was to conduct his disciplinary hearing.

Relief Sought:

In light of the misrepresentations and omissions made by the city staff, as well as the Adjudicating Body’s refusal to discuss or vote upon appellant’s timely objections made prior to the November 15, 2013, hearing, and intransigence in accepting additional evidence at the December 13, 2013, some of which was requesting by the Adjudicating Body itself on November 15, 2013, the Adjudicating Body was unable to make an educated decision based upon complete information, including newly discovered evidence.

Appellant now respectfully requests that the City Council reverse the decision of the Adjudicating Body, and find that Human Resources Board members Norman Powell, Arthur Butler, Holly Evans, Jamie Wrage, Sonya Dew, and Patricia Eibs did violate the Code of Ethics and Conduct in failing to:

1. Create Trust of Local Government

2. Make Unbiased, Fair, and Honest Decisions

3. Treat Everyone with Respect and in a Just and Fair Manner

4. Ensure that all Public Decisions are Well Informed, Independent, and in the Best Interests of the City of Riverside

5. Ensure that All Officials are Prepared for the Exercise of their Duties.

Also, the appellant wishes the City Council to deliberate as to whether ignoring the complainants pre-hearing objections and motions, as well as requested evidence and new evidence, was an exercise in sound judgment on behalf of the Adjudicating Body. Additionally, the Appellant calls for the City Council to set for public review the protocols, rules, and outline established by the City Attorney’s Office for conducting Code of Ethics and Conduct hearings as per the spirit of Resolution No. 22461.

Sincerely,

Jason Hunter

The high cost of liability litigation is costing the taxpayer a mint, his transparency is no transparency when it comes to the taxpayer as in this TMC article, especially when it comes to contracts.  Let’s find a way to curtail this..  Fire the City Attorney…

FIRE CHIEF STEVE EARLEY RETIRING? OR JUST REINVENTING HIMSELF IN ORDER TO DOUBLE DIP?

earlyb

According to a Press Enterprise article, Fire Chief Steve Earley is retiring.  But we noticed he accepted a new position as the City of Riverside’s Fire Administer.  So is Chief Earley really reinventing himself and double dipping into the coffers of the taxpayer again.  Governor Brown has passed a “Double Dipping Bill,” making it illegal.  Is this what is happening?  Is Earley retiring Early to cash in on a good thing, simply because the system is set up to benefit government employees instead for the best interest of the taxpayer.  Now he will mentor three Fire Chief to act as acting chief in a musical chair format.  Are they kidding? No they are not!  How much is this going to cost the taxpayer, to carry on Earley as a temporary employee and to sustain 3 Fire Chiefs?  No one knows, not even Assistant City Manager Belinda Graham when posed the question by the Press Enterprise.  But what is really the PE describes Earley’s new position as fire administrator, they state he will advise the city on fire department issues.  What? Isn’t that the job of a Fire Chief? So, why do we need a Fire Administer?  Is that another word for a paid lobbyist for the city?  Well regardless, we definitely don’t need three Fire Chiefs, there should have been one person already qualified to make the move up.  But again, this is Riverside…  Politically, Earley made local history at the Goeske Center when he had to admit that Measure A, in a TMC store we reported that Chief Earley admitted it was not a City Charter amendment as the City contended, but a “General Tax.”

Is this new position for Earley been designed in colusion with the City Attorney to insure that American Medical Response (AMR) continues it’s monopoly in the City of Riverside?  Earley also proposed that ambulance services should hold accreditation by a private industry association known as the Commission on Accredition of Ambulance Services (CAAS), this despite state and county mandated regulatory standards.  The Press Enterprise called it “arrogant.”  Many in Riverside are calling it a “scam.”  Does Fire Chief Earley have the best interest of the taxpayers at heart?  We think not.  Further, the Commission was found to have other past ex AMR employees on board.  Sarah McEntee, the executive director of CAAS and presenter of the proposal to the Council, is married to current AMR executive Tom McEntee.  Conflict of interest?

Sarah90x134pix

Sarah McEntee, Executive Director of CAAS

The whole scheme or artiface behind this commission appears to ensure the monopolization of the market place by AMR, and those ambulance services who can pay CAAS’s high fees for accredition.  This would leave out smaller ambulance services by design.  Thanks, but no thanks Chief Earley, the PE may call this “arrogant”, we call it plain “despicable.”

But it doesn’t end there folks we did several stories on this regarding the close ties between AMR executives and the City Council and Mayor.  Back in October 2011, 6-1, City Council votes to deny Mission Ambulance a franchise, except for Councilman Paul Davis.  That means American Medical Response, or AMR, will remain the sole medical transportation provider in Riverside. Councilman William “Rusty” Bailey suggested that a council subcommittee review the ambulance policy, but it’s not yet clear if that will happen.  It will never happen, because actions speak louder than words..  Mayor Bailey who was Councilman at the time voted on this denial, and we can see why.  At the time Councilman Rusty Bailey was seen with  having ice cream at a local Dairy Queen with non other than Peter Hubbard of American Medical Response (AMR).

On a side note and on good authority, we found out that now Mayor William “ Rusty” Bailey bought the cone of ice cream for Peter Hubbard.  Could this be a bribe?  You decide.. the point folks in this bit of levity but on good authority, is that we intend to expose the relationships of old family connections which have created a culture of corruption in the City of Riverside.  We are just sorry our source could not attain the ice cream flavor…

     danielwerfel                                  RUSTY

City of Riverside Mayor Rusty Bailey                         Sorry, Mayor William Rusty Bailey

Back in 2009, Conflict of interest charges were filed agailst AMR’s Peter Hubbard, who was also Chairman of the Riverside Police Review Commission.

hubbard

Peter Hubbard, AMR

Back in August of 2012, TMC stated that Fire Chief Earley is also a friend of AMR’s Peter Hubbard.  There has been some talk around town that Peter Hubbard (AMR) hosted Tim Stack (President of the Riverside City Firefighter Union) and Wendy Stack’s wedding reception at Peter Hubbard’s home.  We shouldn’t be surprised, after all, this is River City and screwing is king…  Back in October 11, 2011, sources tell us Councilman Steve Adams, with intentions to run for Congress, was seen with AMR’s Peter Hubbard having drinks at a local water hole known as the Salted Pig.

What else can we tell you of the incestuous relationship with the City of Riverside and even Riverside County.  Well, TMC has found that back in February 13, 2012 the State Emergency Medical Services Authority (EMSA) states that City of Riverside and County of Riverside overstepped it’s authority in limiting ambulance services.  TMC therefore ask the question if the $1.4 Million that AMR provides the City of Riverside each year for paramedic training and equipment contribute to how the City votes on issues that impact AMR?  TMC thinks so, we also think it can be construed as a “bribe.”  Oopps, I said it, and I’ll say it again, a “bribe.”  Others have mentioned that the $1.4 million allows AMR to buy two more minutes from an agreed response time.  This allows AMR to be late by 2 minutes, therefore how does this help the injured?  We say it is just like having a bad burrito, it just doesn’t sit well in the stomach’s of the Riverside community residents.  This of course shouldn’t be the case.

Here’s another exposé of a gem, Bruce Barton, Director of the Riverside County Emergency Medical Services Agency, according to the following document, was previously in the employment of American Medical Response (AMR) back in 2004.  Any surprise to anyone?  Could this contribute to a conflict of interest?

Bruce Barton, Director of Riverside County’s Emergency Medical Agency

Bruce Barton, director of the county’s Emergency Medical Services Agency, and Tom McEntee, AMR’s general manager, said Thursday there was no intent to mislead anyone at the Oct. 17 workshop. Information about the rate increase was widely available online, Barton said.  Let’s not forget the accreditation company CAAS,  Sarah McEntee, the executive director of CAAS is the wife of AMR’s general manager, Tom McEntee.  Incestuous?

According to public speaker Rebecca Ludwig, could “Golden Boy”, Riverside County Supervisor, John Taviglione have a part with AMR?

So what is next for General Earley, oopps, retired at work again Fire Chief Steve Earley?  You decide…  You are always right, citizens of Riverside, make your opinions be known at City Council and not be afraid of retribution by the City as some residents have indicated.  One we are none, more than one we are many….

Will the real Steve Earley please come forward..

As one local Riverside critics stated, “Would that mean its OK to embezzle as long as you don’t go over the budget?”

Of course, you know, there is more to come… stayed tuned for another episode of “As Riverside Turns Your Stomach”.

UPDATE: 01.07.2014: CITY OF RIVERSIDE BACKS OFF WITH THE HIRING OF THE FIRE CHIEF DUE TO PUBLIC PRESSURE ACCORDING TO THE PE.

With this, questions still linger regarding the process that went down.  Why is the Fire Union making decisions regarding the taxpayer?  Why is it that the City, through City Manager Scott Barber, must look elsewhere, outside the City for a new Chief?  Don’t we have capable people who can move up the rank, such as Deputy Chief Mike Esparza.  Incidently, Mike Esparza was chose to be the interim Fire Chief until a new one is found.  I just say we keep the new Fire Chief Mike Esparza.

Esparza-269x300

Esparza will take charge until March 2014; the next in roatation are Division Chief Bill Schellhous from April through June; and Division Chief LaWayne Hearn from July through September.  Again if we are touted as having the best of the best due to are training, why must we look outside for another candidate?  Time and time again we see the same scenario, we’ve seen it with Police Chief Sergio Diaz, another double dipper.  But remember this was also the legacy of the prior City Manager who skipped town when he seen the writing on the wall..  Brad Hudson.  Hudson was responsible for the hiring of Police Chief Sergio Diaz as well as Fire Chief Steve Earley, from the County of Riverside whereby Hudson previously worked, not to mention our current City Manager Scott Barber, former Public Works Director Siobhan Foster, who was said by insiders didn’t know what a “pot hole” was,  and current Human Resource Director, Rhonda Strout, known in some circles and “Luxury Girl”, who had her own set of problems with the cost of liability to the tax payer with current employees.

According to this PE posting, Chief Earley in his new position of Fire Administrator, would have offer his expertise on the city’s ambulance policy and the county emergency medical services system.  Again we need to ask the questiion of what is the Fire Unions role in the decision making process in the City of Riverside.  Secondly, are there ulterior motives involved between the City and the Unions to insure the continuation of the infamous ambulance monoply known as American Medical Response.

UPDATE: SCORES OF RETIRED, AND EX-FIREFIGHTERS AND EX-POLICE OFFICERS INVOLVED IN DISABILITY SCAM.  According to the L.A. Times many of them were coached before going to physician’s to be evaluated by their attorneys and supported by their unions.  This is the kind of behavior that concerns people in Riverside.  Many of them were found going fishing, riding motorcycles, running, going on cruise and working other jobs.  The let down was the taxpayer, who placed these individuals on a heroes pedestal.  These indivduals didn’t care, only for their own self interest at the expense of the hardworking taxpayer.  More arrest eminent, the fraud has been predicted to extend beyond $400 million.

Boys just want to have fun, even on a disability retirement..

In Riverside we had the case of retired and ex RPD officer Chris Lanzillo, who was given a medical retirement/pension and went on to start his own investigation firm in Orange County.  Another medical/disability retirement fraud case?  Lanzillo was a former Union President for RPD and somehow connected to doing work for the law firm of  Lackie, Dammeier & McGill, which their offices were raided by order of the Orange County D.A. office.  Since then two Costa Mesa Councilman sue the law firm and it eventually closed.

chrislanzillo

Let me see if I’ve got this straight…A Riverside detective named Chris Lanzillo gets fired…then is called back so that he can be retired early on a medical disability…which qualifies him to recieve his pay in large part tax free for the rest of his life.  BUT…he’s not so disabled that he can’t work as a private investigator for a law firm that represents cops and cop unions…and shall we say…suuplement his retirement pay……Is that absurd or what!  He’s a bad cop who’s now a crook…and we got to pay his freight for the rest of his life!  – John Bosch, Commenter on the Orange County Register

UPDATE: DWP UNION CHIEF, BRIAN D’ARCY, OF THE INTERNATIONAL BROTHERHOOD OF ELECTRICAL WORKERS REFUSES TO TURN OVER FINANCIAL RECORDS OF HOW PUBLIC MONIES HAVE BEEN SPENT TO AUDITORS.

Brian D’Arcy, Union Chief IBEW

Ron Nichols confided at a  private meeting with the DWP Board of Commissioners that IBEW Union Boss Brian D’Arcy had made the threat, and Nichols said he was worried the City of L.A.  would not defend him in a lawsuit, according to two officials who attended the  meeting.  Is this another example of how the Goodfellas continue to infiltrate public sector monies by strong arming and threatening public officials for their own self greedy gratifications?  It is apparently appearing to be so.  Alleged corruption of this magnitude should not be tolerated by the public at large.

Ron Nichols, former DWP General Manager

“D’Arcy told him that if he were  to ever share any information, D’Arcy would sue him personally as a breach of  fiduciary duty,” DWP Commission president Mel Levine told KFI NEWS  Friday.  What also appears eminent, besides unions being in control of many public service aspects, many of them have infiltrated are political system with façade of representing the taxpayer.  Remember folks, we are dealing with rate payers money.  Money which is in the realm of Public Utilities, owned by the taxpayer.  Some commenters were stating that that the unions were no better that the mob.  I do believe that not only the taxpayer are hurt by union action and behavior, but the union workers, which the union’s use for their benefit.   Read more: http://www.kfiam640.com/articles/local-news-465708/outgoing-dwp-boss-threatened-over-secret-11964091/#ixzz2qAgvmZrm

UPDATE: FULLERTON POLICE NOT GUILTY IN MURDER OF KELLY THOMAS  Sobs fill courtroom..  Many are asking the question, why aren’t police cleaning house of the bad apples?  If not, is the beginning of a police state mentality?  Where by the judge and the jury accepted the actions of the police.  Will it be acceptable that the police act as the judge, jury and executioner, and the court system only a formality?  Should we as residents and citizens be concerned and afraid?

Tuesday night’s City Council issue on ethics and how complaints should be handled, became heated at public commented on this issue when Self Appointed Citizen Auditor revealed what a relative and Poly High student said about some of the female public speakers during a Government Class in which William “Rusty” Bailey is the instructor.  Former Deputy City Attorney Raychele Sterling chimed in with reading a formal ethics complaint against Councilman and teacher Bailey, which was submitted to the City Clerk.  Bailey took the microphone and lashed out the following response to the accusations made against him.

So, now the truth behind these accusation’s, occurred on Constitution Day when I was teaching my students about freedom of speech and the first amendment rights that they had.  And giving them an opportunity to see public comment.  And encouraging them to come down and comment on any item they’ve wanted to.  Ahhh, including things that are put to them as skate parks.  I’ve had student come down on several occasions to comment on items like ball fields, and skate parks, and school issues and I will continue to do that…

So if Constitution Day isn’t an appropriate time to show public comment, I don’t know what is.  The next time I showed a video was before the Nights of Arts and Innovation to encourage my students to come down and participate in the long night Arts and Innovation which occurred last Thursday night which many of them did, many of them received community service credit for doing that.

Because I believe in getting them involved in City and exposing them to some of things that we are doing down here, such as the City Council meeting, and so they get community service hours for doing that, never did I disparage any single person or say “stupid” anytime during my class, thank you.

Now, Constitution Day that Councilman William “Rusty” Bailey is referring to, is September 17, 2012, and Arts and Innovation Night was Thursday, October 4, 2012.  Councilman Bailey never did say “stupid” in his class, but what about the use of the term “crazy”?

Accordingly, news reached complainant, Vivian Moreno, via two students.  One that attends Poly High School here in Riverside, and the other, the grandson, does not.  After coming home that Thursday the 4th, after a presidential debate party, her grandson, Joseph (not a student at Poly High), who was doing his homework at the dining room table, told her that Bailey was talking about her in class today.  In her inquiry for more information, found Joseph had spoken to his relative, who is a student at Poly High School.  So what did she say, Joseph?  She said that the ladies who spoke were “stupid”, and then noticed you were sitting behind one of the public speakers, and said, “that’s my grandma”.  Bailey then shut the video off.

The following is the email dialogue of the following day, between the Poly High Student and Vivian Moreno to inquire as to more detailed information.

Moreno:  Joseph told me last night that Rusty Bailey mentioned me in his class room.  Would you mind letting me know what he said?  Did he say we were Stupid?  I will keep this very private.

Poly High Student:  He just said, “this is what I have to put up with and some ladies are crazy”.  It was the video with the lady with the long black hair and red shirt on.  You were sitting and wearing white.  I said “that’s my grandma” and he turned the videos off.  Haha, but somehow now I failing his class.  I don’t like him one bit!!  and when he cut the lady off in the video and she was saying “this is why people shouldn’t vote for you….Rusty”.  He was laughing at the lady in the video.

Moreno:  How many times has he played these videos in his class?  and why does he play these videos in his class?  Does he offer extra credit to his students for walking for him?

Poly High Student:  Two times, and I don’t know why he plays the videos, he just does it at the beginning of the period.  And no extra credit that I have heard of.

Moreno:  Were they both times he was Mayor Pro Tem?  Does he say anything about him being Mayor?

Poly High Student:  Yes, and he says he’s running for mayor, but that’s all.

Moreno:  Were the two times on Wednesday’s these last two weeks?  Did you have any kind of discussion of class assignment for viewing them?  or are just viewing them because he is so full of himself?  Those videos are long how much class time did he spend on them?

Poly High Student:  Just the discussion when he was saying those people are crazy and I look what I have to deal with.  He usually lets them run for about 5-10 minutes at the beginning of class.  He fast forwards to certain parts.

Moreno:  Thanks if I have other questions I will ask.  On my way to L.A. see you soon. Thank-you.

Poly High Student:   Okay, no problem.

Councilman Bailey made local headlines earlier this year for accessing Riverside Unified School District employee emails to solicit mayoral campaign information.  Some considered this an inappropriate application of state public property for personal use, and unrelated to any school business.  According to the California State Constitution Government Code 8314 (a) states, “It shall be unlawful for any state officer, appointee, employee or consultant to permit others to use state resources for campaign activity, or personal or other purpose not authorized by law”.  Work emails are considered state property and not to be used for campaign activity.

According to School Board Member Kathy Allavie, he was exercising his free speech right.  Yes that is true, but utilizing the tools of public property for an unrelated use is a violation of the state contstitution.  Regardless, Bailey still has his supporters, and accordingly, all the hooplah doesn’t really matter in the case of this one commenter in this Press Enterprise story by Dan Bernstein, Riverside: Should People Who Lodge Complaints Remain Anonymous?  But I’m still taken back at the fact that Berstein still considers public commenters exercising their first amendment rights to free speech as “gadflys”.  Sorry, Berstein, that’s quite belittleing and demeaning considering this is an essential part of the democratic process.

If this is the worst thing that can be said about Rusty, he still got my vote.  – John McCombs, Elementary School Principal at Riverside Unified School District, Commenter on the PE.

I question the use of “got” for a Elementary School Principal, but that’s jus, opps..just me…

Other’s are also asking the question, if the city’s famous P.I. will be taking up the investigation of the Bailey to investigate the usual one side?  Of course, we are talking about former RPD Lt. Jeff Callopy.  Friend of Whom?

The following is a code of ethics and conduct complaint that Self Appointed Citizen Auditor Vivian Moreno submitted to the city clerk.

DESCRIPTION OF EVENTS AND MANNER IN WHICH CODE OF ETHICS

VIOLATED BY COUNCILMAN WILLIAM “RUSTY” BAILEY

On Wednesday, October 3, 2012, Councilman William “Rusty” Bailey (Bailey), while instructing a Government class in his capacity as a high school teacher at Poly High School, did make disparaging remarks about women who exercise their first amendment rights to political speech during public comment at Riverside City Council meetings.  According to a relative of mine who is a student in Bailey’s Government class, and was present on the day in question, Bailey had presented a video of a City Council meeting so that his students could see him acting in his capacity as Mayor Pro Tem.  When a student inquired of Bailey who the public speakers were at the meeting, Bailey replied: “This is what I have to put up with, these “crazy ladies.””  Thereafter, a female speaker, believed to be Karen Wright, was shown on the video, stating “Don’t vote for Rusty Bailey”.   Bailey began laughing out loud at the speaker, mocking her.  One of the students then replied: “Hey, that’s my Grandma.”  Thereafter, Bailey commented “she’s weird” and immediately turned the video of the City Council Meeting off.

Bailey’s actions were disrespectful, offensive and sexist to both the speakers and the young women present in his class, in violation of paragraphs G and H of the Ethics Code.  The impressionable young women in Bailey’s class should have been encouraged to exercise the most fundamental right guaranteed under the United States Constitution, “free speech”.  Instead, they were discouraged and left with a feeling of inferiority, that if, as women, they were to exercise their first amendment rights and speak their mind; they would be labeled as “crazy”.  Bailey made no reference to male speakers, nor did he use a sex neutral word, such as “people” or “individuals”.  His intent was clearly to target the women speakers.

I’ve since learned that Bailey has shown at least two videos of city council meetings to his government class where he was acting as Mayor Pro Tem.  According to my relative there was no discussion during or immediately after the video that related to the required curriculum or class plan. It appears Bailey was using the video of the council meeting not as an educational tool, but rather to seek favoritism from his students in his bid for Mayor.  My relative also advised that Bailey had discussed a bid for mayor in the classroom before.  This actions constitute a violation of paragraph F of the Ethics Code, as Bailey used his position as a Councilman and Mayor Pro Tem to further his campaign for Mayor of the City of Riverside.

“THE GOLDEN BOY”..RIVERSIDE COUNTY SUPERVISOR JOHN TAVIGLIONE.. ACCORDING TO PUBLIC SPEAKER REBECCA LUDWIG..

Even when you have a code of ethics, policy and procedures, you only apply them or use them when it’s convenient for you.  If somebody like me, comes down here or anyone else, that is in opposition, holds you accountable, then they apply, and you guys don’t play fair…

I’m going to give you an example of what happen to me, not necessarily with you, but with your “Golden Boy”,  Mr. Tavaglione, (Riverside Supervisor JohnTavaglione is incidently currently running for Congress).  Now, remember here I’m protected by Civil Code Section 47,(Privileged Communicaitons in California).  He baited me for a name, I gave it to him, I was then served with papers, was sued, taken to small claims court, the judge or the commissioner, whatever you want to call him, awarded him the judgment, he was a good friend of the “Golden Boy”…

I had to write up to the Attorney General saying there was a miscarriage of justice.  Lucky for me, she saw it that way to.  They brought in a judge, because I told her that if you get an attorney here, some judges, not all, they are in bed with all of you guys. The Board of Supervisors and the City of Riverside, you cannot get any justice.  And they did reverse that judgment on my appeal.  The judge also made a statement, made it very clear to everyone present, that he was brought in from out of the area.  The two mediators were from Seattle, Washington.

So, when somebody comes up here and tries to hold you accountable, you take it as an attack.  We are here because we care enough about this city to get involved.   I was only talking about senior abuse and protecting our children and look what happen to me, and that’s only one incident.  I also told you about my tire getting stabbed, being harassed at my front door four different occasions and threatened, twelve perpetrators, and I do have affidavits to prove this, and if you want to settle this going on, have them sign an affidavit.  You take sign affidavit and take it to court and see what happens, see who is telling the truth.  I’m all for justice, and you guys, not all of you, but most of you don’t play fair…

When we come up here and we address you, please don’t take it personal even though it may sound that way, and if it is, it’s because it is justifiable…

TMC knows that Mrs. Ludwig is not alone.  There are many stories from the citizens of Riverside who have had similar experiences.  They feel intimidated and are afraid to come out with their stories.  Thank-you Mrs. Ludwig for you courage to come out with yours.

WHAT DID COUNCILMAN PAUL DAVIS HAVE TO SAY ABOUT THE CODE OF ETHICS?  YOU GIVE UP THAT PRIVACY RIGHT WHEN YOU MAKE A COMPLAINT AGAINST A PUBLIC OFFICIAL! …..WE ARE PUBLIC OFFICIALS!

Councilman Paul Davis started out by statiing that he did have issues with some of things that City Attorney, Greg Priamos said.  Some of the issues is that some of the language needs to be changed to “any person”.  In otherwords, no public employee, whether it be it an employee of this city, has the authority or the idealism that if a complaint is made against a council member, an elected official, who is not a city employee, that can be handled by Human Resources; that employee who makes that complaint should  have “no expectation of privacy”,  and there is no law in the books that says that they do.

That’s like myself like myself making a complaint against Vivian Moreno (Self Appointed Citizen Auditor), the same thing abides here.  If you have to make a complaint against a council member, that council member and that employee, a public employee can go to Human Resources.  Staff has no authority at all to investigate a council member under any circumstances!  You don’t have that authority, only the commissions have that authority.  Therefore if a city employee does choose to file a complaint of any sort.  It is a considered complaint on ethics on a councilmember, be it the mayor or anybody .  We cannot abridge that process. We don’t have that authority.  That is a violation of the charter.  And you can’t tell me that there is any law in the books, anywhere, that says any different.

And the process is that we are public officials.  Just like when President Clinton went through the process with his issue, there is no difference.  We are no different that person is at all.  And there is no expectation of privacy on anybody’s side.  “You give up that privacy right when you make a complaint against a public official!”  Unless it’s a criminal act that is so heinous that they are protected under certain laws.  Just simply a disagreement, for example, is not a protected right.   So I do say any person, or any entity, makes a complaint, be it the Human Resources as an employer or anywhere.  It needs to go through that process.  The public has the right for us to be before them, if you will, and be tried, if you will, before them.  Not behind closed doors at anytime.  It is a “public issue”, and that person be a public employee or otherwise has to understand that, that’s the way it works. You can’t have separate rules for seven things for separate people.  “We are public officials!”

FORMER DEPUTY CITY ATTORNEY RAYCHELE STERLING: AN ALLEGED KNIFE INVOLVED BETWEEN TWO COUCILMAN’S AIDE’S?

“Rusty, actually at the last council meeting, I thought you gave a really, really nice prayer… and you asked for blessings of your employees, and unfortunately I didn’t feel that prayer was heartfelt, and that was really saddening to me, because I feel like the actions that are taken really aren’t ever in the interest of your employees, or bringing blessings to them, but rather just bringing them heartache and hurt to them, so I really hope that you meant that prayer and you are going to try to make a difference of what’s going on in the City.”

I believe this was brought up because Councilman Bailey is on the Board of Leaders of Godly Character International.

“I did want to address some issues about privacy for employees, it depends on who you are whether you get those privacy rights. .. every city employee is entitled to them.  But, I received a call, a while back, from a young lady named, Alicia Robinson (Riverside Press Enterprise), I didn’t even know who she was, I had no idea how she could have got my cell phone number, somebody from the City must have given it to her, and she had all three of my harassment discrimination complaints.  So where was my privacy?  This woman calls me, I don’t know who she even is, she’s from the press, and she has all my discrimination harassment complaints, it was very, very disturbing to me.  So, it depends who you whether you are if you are entitled to that privacy.  If you speak out against the city you’re probably not.”

I talked about Maria Lamping last time I was here, and in the notice she received there was a confidential settlement brief, protected by the federal rules of civil procedure, and that was unlawfully released by the City Attorney’s Office, by the Public Works Office, by Tina English and I want to know, are those people being subject to administered interviews?  Are they being subject to being on administer leave?  Probably not, because they bobbled their heads accordingly.

“The other thing that I heard, it’s just rumour, so I don’t know if it’s true, but I heard that Councilman’s Chris MacArthur’s Aide held a knife to the throat of your Aide, Rusty.. I don’t know if that is true.  If that is true and you allow an employee who poses that kind of violent risk to other employees, and to your constituents, Chris, because he is going to their home’s, and you allow him to remain here?  And yet you allow other employees to be fired for frivolous reasons.  That’s a slam dunk that you are discriminating, harassing and retaliating against your employees who are whistleblowers, and that you are permitting it to occur from management and gratifying it.”

Councilman Chris MacArthur’s legislative aide is Chuck Condor..someone who has appeared to continue to slide by the City’s Code of Ethics..so is this Code of Ethics really a charades, as many are asking?  A broadway show at our Fox Theatre that seemingly cost to much to see?

This allegation regarding this alleged altercation between Councilman Chris MacArthur’s Aide, Chuck Condor, and Councilman and Mayoral Candidate William “Rusty” Bailey’s Aide, Mark Earley, came through the pipelines in and about April 23, 2012.  Currently, we still have not received any substantive information from City Hall to corroborate these allegations.

Sterling went on to say, “Steve, that is not a personal issue, that it is a policy issue, because that creates liability for each and everyone of you.  At this point it may even creat punitive damages against you personally, I don’t know I will have to do the research on that..”

UPCOMING: WHAT DID JOEL UDAYKE, OWNER OF THE FLOWERLOFT,  HAVE IN A VICTORIA SECRETS BAG FOR CITY COUNCIL DURING PUBLIC SPEAKING?

I’m going to talk about the state controller, I know everybody is tired of hearing about it, but we are worse than the City of Bell, we are in debt, 3 to 4 billion dollars.

So I felt kind of weird last City Council meeting, everybody brought props, so I brought some props, I brought this (and orange jumpsuit), does everybody recognize that?  It even comes with jewelry (handcuffs).

Is there any compelling reason why none of you elected officials have called the State Controller?  If there’s nothing to hide, why hasn’t anybody called?  I know it will be a public relations disaster, when they find all things that has happened in the city, when spending tax payers money and redevelopment money incorrectly.  When is somebody going to call? When is somebody going to do the right thing?  We have all the information..

Dvonne, Vivian, Raychele have the information for you, …City Council person call and get an audit, Brad Hudson (former City Manager) isn’t here anymore, you shouldn’t have any fears.

In closing,  “It’s easier to tell the truth, than a lie”….”You never forget the truth, you always forget a lie”.

Call the State Controller.  We’re here, to talk to you, and get this on the road, it’s going to be a public relations disaster, because of this city being this perfect entity, but have to know where are money went and the people who are responsible for it need to be wearing orange…

WHAT COUNCILMAN IS SEEN OUT AT A “DAIRY QUEEN” WITH A CONTROVERSIAL FIGURE?  SOME OUR ASKING, “HOW MUCH CAN AN “ICE CREAM CONE” GET YOU IN THE CITY OF RIVERSIDE”?  WELL IT APPEARS TO BE ALOT..

According to the last campaign mailer sent to voters homes, Mayor Ron Loveridge stated of Bailey, “Rusty Bailey has the highest possible commitment to public service, reinforced by his years at West Point.  Values are important in being Mayor.  He is not wedded to any special interest.”

The same evening that Bailey was to debate opponent Mayoral Candidate Ed Adkison at the the la Sierra/ De Anza Park Senior Center Debate, whereby he spoke in favor of Peter Hubbard’s AMR, and the rational of using one ambulance service in the City of Riverside.  Councilman an Mayoral Candidate William “Rusty” Bailey was seen at a local Dairy Queen, with non other than American Medical Response, Peter Hubbard on October 4, 2012, therefore contradicting Mayor Loveridges’s endorsement.

UPDATE: 11/06/2012:  On good authority, Councilman Rusty Bailey bought AMR’s Peter Hubard the ice cream.. The question is how much can a cone of ice cream get you…
