On June 25, 2013 at City Council in the City of Riverside, Letitia Pepper, Esq., former Best, Best & Krieger Attorney, was arrested for clapping in approval of statements made by public speakers.  If you recall, public speaker Karen Wright was arrested last November 2012 for speaking 16.8 seconds over the 3 minute rule.  Mike Fine, Deputy Superintendent of RUSD, went over the 3 minute with no provocation or arrest by the mayor.. Regardless, Mayor William Rusty Bailey, as an audience member coined, “Lil Hitler”, felt strongly enough to sign the citizen’s arrest form that activated the arrest of Ms. Pepper.  Bailey, a government teacher, should know the constructs of the First Amendment, otherwise, what was he teaching his students?  A little power can certainly make you forget that you are there to serve the public.

Once she was arrested and removed from council chambers, the audience responded with clapping in support of Ms. Pepper.  Was her First Amendment right of free speech impinged?  It is likely that this could be explored in a law suit against the City of Riverside.  What will clammed up City Attorney Gregory Priamos have to say about this?  Well he’s pretty much saying nothing about nothing these days..

So why is Bailey clapping in approval without being arrested? Has he now become the decider?  What will King Bailey do next?  Send the masses of clappers to internment camps?

Ten days ago this document was handed to Mayor Bailey in demand for a public apology for unlawful and discourteous actions at Council Chambers June 11, 2013.  Ms. Pepper was representing three citizens, Vivian Moreno, Joel Udayke and Dvonne Pitruzzello regarding his position on no applauding during public comment.  Was this in fact, a personal vendetta against former BB&K Attorney, Letitia Pepper by Mayor Bailey? Why was Ms. Pepper targeted for removal and arrest my Mayor Rusty Bailey, when there were multiply clappers?  Why weren’t the other clapppers removed and arrested?  Is this the Mayor’s attempt to control public participation in government?  Is the arrest a show of force in an attempt to initimidate the public not to participate in government?  Currently the Mayor Bailey has passed the 10 day response time.  We’ve yet to hear of a statement from Mayor Bailey or even the clammed up in his office City Attorney Gregory Priamos.  But is there more to Priamos’s life than we know?  More to come on TMC..

But I guess the questions many are asking these days, even those who voted for Rusty, what is he doing?  Again as many residents have said, they feel the city will retaliate against them if something derrogatory is said regarding city politics.  So why is it?  Many are asking, is it because of the history of Rivserside, whereby a conglomerate of politically tied families made the rules and the basis for politics in the City of Riverside?  Which of course includes the Bailey family.  You have Mayor William Rusty Bailey’s father judge and then you have the fathers friend who was a founder of incidently, Best, Best & Krieger.  Halleluah, are we actually coming to anwers of why the City of Riverside is the way that it is politically?

In this pic we see Bailey’s father, Judge William R. Bailey II, with now Mayor William “Rusty” Bailey (middle) , and Judge John Gabbert.  Judge Gabbert has a history going back to the 40’s which answers the question of why the City of Riverside uses Best, Best and Krieger so much..

Judge John Gabbert, in younger days, a Quandrangle of Influence within the City of Riverside?  What is the connection between Best, Best & Krieger and the City of Riverside?  What is taking that hold on Riverside that has everything to do with old family influences?  You get my drift, I wouldn’t attempt to try this case on the constitutionality of ‘clapping’ within the City of Riverside.

Even RPD Investigator Michael Blakely decided to get into the act as Rusty’s bouncer.  Will he be asking the tough questions to Pepper as he did in the Neely Nakamura investigation?  Holy Cow! even the Chief of Police Sergio Diaz was there for the arrest..  This whole endeavor perpetrated by the Mayor himself, took 4 police officers, a police vehicle, RPD Investigator Michael Blakely and of course, the Coup d’état, the double dipping Chief himself, Chief Nacho Cheese, Sergio Diaz.  (Nope, nope…no police helicopter this time).  We also thought the good police officers were going to take Ms. Pepper for a ride around the block with sirens blasting in a show of force to the community, that of course, clapping is not allowed at public comment.  That didn’t happen, she was taking down to the Orange Station for processing and released.

    Something is missing here. Was she warned about applauding prior to the arrest? It does not seem reasonable that someone would be arrested for simply applauding a speaker. Have you given us an unbiased story here?

      Seriously Jim, this is about being arrested for clapping, Have we’ve become so politically correct or do we have a mayor who finds the need to control free speech in the only way he can?

      Bailey told her to stop clapping, but he cannot do this. Remember she only clapped after a speaker finished speaking and before another speaker came to the podium to speak. Bailey allows clapping for presentation by his cronies that come down to support him.

      Jim the video showed other people clapping as they either agreed. I respect the Mayor saying no clapping but to single out one person seems odd. Even after she was removed and a few people stayed during the council hearing the tape showed people clapping after a statement by Councilman Mac Arthur and people agreeing on his comment which did not seem to be a problem. Look bottom line Pepper was singled out and end of story. We either accept the new rules of never speaking any disagreement with the Mayor and only praising him or expect to be arrested. I still could not get pass the 3 mins. talk after being to so many council meetings and listening to concerns of citizens. Wasn’t it interesting to see a lady speak out against the President and wow she spoke her mine and was asked to leaven after she finished what she had to say and never arrested or charged with a crime. Just think an American can speak out against the President of the United States but can’t speak out against the Mayor of Riverside.

    Both the United States Supreme Court as well as the California Supreme Court have ruled that applause, cheering and even the stamping of the feet are in fact protected rights under the first amendment.

    Mayor bailey two weeks ago asked three other citizens were warned three weeks ago of the clpaaing and Mayor Bailey was warned that this violated their first maendment rights. They aslo demanded an apology. ms. pepper only clapped after the speakers spoke and before the next speaker. He controls speaker time but not the time inbetween speakers. No apology to date. bailey was also warned of a lawsuit should he not stop asking people to clap.

    William “Rusty” Baily, needs to remember he is not GOD, Just the mayor of the PEOPLE of Riverside, Ca , the city. Even a mother allows her children to express there emotions in a calm manner. This is life. This is individualism. I am very concerned with a Mayor and council who think they can control the every expression of any citizen in this city Those who earn and who pay for the privilege to do so. Are they so better than the people they serve, that they can control your every expression?

  6. Riverside City Attorney Greg Priamos is too busy getting spanked by the Riverside County Grand Jury for violating “secrecy” of the process during its most recent investigation of the Riverside Police Department.

    The City of Riverside has elected a Dictator in charge and Democracy is gone. Many agreed or disagreed with Mayor Loveridge but he allowed the public their Constitutional rights to freedom of Speech. Now we are ordered to only approve what this Mayor says and stay silent if you disagree. Voters were put on notice Oct. 2012 when Bailey directed the City Attorney to arrest Karen Wright for speaking her mine and now Mrs. Pepper was arrested by order of Mayor Bailey for doing what others had done (clapping). As other Dictators have done people either obey or get arrested. We can’t say we weren’t warned and even saw the corruption Bailey did to get votes. Time for all citizens to say enough is enough and have a recall to get a Mayor who will work for the people and follow the Federal rights covered in the US Constitution. If voters and citizens do nothing more legal settlements from lawsuits will come at the taxpayers expense. Few realize Karen Wright will have a criminal record even when her charges were dropped because she should have never been arrest by order of the City Attorney. Now Ms. Pepper has a case of false arrest and a lawsuit will follow.

      Jackie: Let’s get our facts straight. Bailey was not Mayor when Karen Wright was handcuffed. That was done by the so-called defender of free speech, former Mayor Ronald Loveridge. I agree that Bailey is wrong in this hand-clapping incident, but he wasn’t in charge in the Karen Wright incident.

    Kaptalizm Let’s look back at what Karen Wright was saying and it was a month before the election. The video was shown nationwide and it was clear why she was told to stop. We know saying things done wrong by a candidate running for Mayor could lose votes. The only person with votes to lose or harm could be done before election day was candidate Rusty Bailey. Karen knew the reason and so did anyone who watched and listened to the video. Mayor Loveridge had nothing to lose so he really didn’t care as it showed him. This is just another example of conduct by a Mayor and Rusty will not allow anyone to disobey him or speak out against him. Had there been cheers for the Mayor we would have seen approval. Look for more dictatorship as notice it started before he took office and all employed will follow as told. I just feel we will have more lawsuits and embarrassment done by elected officials. I got a call from my sister in Florida as their news showed the video and I told her how great Riverside was and so proud of my city.

  9. I actually thought that was one of the few real gaffes Loveridge made as mayor as most of the time it’s difficult to trace it back to him. It was in November 2012 if I remember. Bailey, not surprisingly it just took him less time in office as mayor (and chair of the CC meetings) to screw up. Not surprisingly given his inexperience.

    It’s fascinating how the PE still hasn’t published its promised story on Priamos’ latest screwup coming to light. But then with journalists leaving print and now online media in droves and heading straight into PR jobs (as the other fallback, teaching is more competitive), perhaps not surprising.

      I agree it is fascinating, but not surprising for the reasons you said. Why the City has not terminated Priamos is beyond me, especially after the Schiavone development snafu that cost the City a lot of money. What has he got on everyone that keeps them quiet?
