IS THE SWORD OF DEMOCLES HANGING OVER THE CITY’S HEAD?

Vote No on Measure-Z folks!  Have you always believed that local Riverside Police and Fire had your back, and had your best interest at heart?  Not so, think again..  They have always thought of themselves before the taxpayer and TMC will prove that these so called Heroes, are really imposters of deception, disguised in sheep clothing, making you believe, you the taxpayer are of the utmost importance.  But not so, they will deceive to attain what they believe they are entitled to.  Your money, your hard earned money, and will continue to make you believe that it is well spent.  Not so folks, the reality is that your public servants are charlatan and  masters of deception when it comes to tax monies, and these opportunist should be exposed.  It is a sad case when your public servants care more about their entitlement pay, then servicing the public!

Example One: Tim Strack, President of the Riverside City Firefighters Association (Fire Union) has set aside $100,000.00 to the campaign on Yes on Measure Z, to get this tax through so his firefighters will continue receive their high pensions.  But Strack is singing the same tune he did a couple of years ago when they lied about the No on Measure A campaign, and said we would lose important services in the community, and if Measure A didn’t pass we would have problems in service.  Well folks he lied, lying Tim continues to lie about Measure-Z.  This $100K started out as taxpayer monies when given as salaries to the firefighters, then give to the unions as dues, then the unions utilized it on issues that benefit themselves.  This is the “laundering” system in action.

Example Two: Brian Smith, President of the Riverside Police Officers Association ( Police Union), attempted to ensure the audience at the Goeske Senior Center that “monies wouldn’t be squandered because the Police Association would be watching.”  Sure Brian, you weren’t watching when you were embezzled out of $350,000.00 of member dues as this CBS report explains.  Brian, are you going to tell the taxpayers that no officer in your association could read the books?  So guys, if you can’t protect your own back yard, how can you confidently protect the publics?

Example Three: All non-profits that can’t make it on their own, and depend on “taxpayer welfare,” of course, are for Yes On Measure-Z.  This would be the notorious Raincross Group and the boldly infamous Riverside Chamber of Commerce.

THE FOLLOWING IS INFORMATION FROM THE “NO ON MEASURE-Z” CAMPAIGN:

By passing Measure-Z, the City of Riverside’s tax will double from the current 8% to 9%, becoming the biggest tax increase in our City’s history.  Also, remember as some of friends have told me, If I bought a high price item, as a new car, I’ll just buy it somewhere else where the sales tax is lower.  Not so, if you buy a car anywhere, you will still have to pay the Riverside tax, because the tax is tied to you home property address.

Secondly, the new tax gouges Riverside Taxpayers by inadvertently raising “five times” the amount needed to “balance the 2016 City budget.”  Measure-Z fleeces the taxpayer for $2 billion over 20 years.  We find this excess is purposely done, that continues to encourage the City of Riverside’s bad behavior of “wasteful spending.”  Measure-Z is a “regressive general tax.”  What this means is that your tax dollars will be spent on anything the elected officials dream up in the next two decades….without voter approval.

The best part for the City Establishment is that there is no specific taxpayer accountability written into Measure-Z.  This means that the City is not “obligated” to tell you how your money is spent!

Thirdly, Fine Print, Measure-Z tax monies can be “diverted” from “vital services” to:

  • Build a new City Hall, Trolley System (Remember the Brockton Bike Lane Bug-A-Boo) or expand the Riverside Convention Center.
  • Raise “salaries and benefits.”  Don’t you see Fire and Police salivating like Pavlov’s Dog?  Google “Salaries Riverside 2015 Transparent California.”
  • Pay down predominantly soaring Fire and Police Pension Debt. The City of Riverside are ‘horrible’ negotiators for the taxpayers.  Currently, for example, the City of Riverside has been paying the entire cost of employee pensions, $71,811.00.  Police and Fire pension average $108,173.00  Pretty incredible!  I have a Doctorate in Clinical Pharmacy from USC, a B.S. in Pre-Medical Sciences from Loyola Marymount, and an emphasis in Medical Bacteriology from California State University Los Angeles, and currently receive $12K in a pension per year…. go figure!

Again beware of “scare tactics” from the City of Riverside.  TMC has been told that the “financial condition” in the City of Riverside is “dire,”  but the City is “lying” again, as they did with Measure-A.  How are they lying?  Through their teeth, because “official budget documents” state there is “absolutely no financial trouble,” and the City Manager reports that “prudent belt-tightening” is enough to balance budgets and restore services.  Don’t Be Misled!

TMC has been dealing with this issue since we battled with the City with our Downtown Business in 2011.  What we have with the City is a “failure to communicate.”  What TMC has been stating for years is that “we do not have a revenue problem, we have a spending problem.”  Realistically, the City of Riverside is “rolling in doe,” therefore Measure-Z is not needed!  Tax Revenues are at an all time high and expected to keep on growing.  For example, Riverside Public Utilities provides a huge revenue source other cities don’t have …… $45 million from your Surplus Utility Rates which goes directly to the City of Riverside General Fund!

Fourthly, City Unions, which unfairly positions City Employees against the taxpayer.  The Fire Union under Tim Strack, pledges $100,000.00 to the Yes on Measure-Z campaign, in the hopes that Measure-Z passes, thus ensuring, bigger pay increases and higher pensions to the “rat bastards!”  Remember, these ‘public servants’ have betrayed us!  Back on August 16, 1937 President Franklin D. Roosevelt state this on “public sector unions.”

All Government employees should realize that the process of collective bargaining, as usually understood, cannot be transplanted into the public service. It has its distinct and insurmountable limitations when applied to public personnel management. The very nature and purposes of Government make it impossible for administrative officials to represent fully or to bind the employer in mutual discussions with Government employee organizations. The employer is the whole people, who speak by means of laws enacted by their representatives in Congress. Accordingly, administrative officials and employees alike are governed and guided, and in many instances restricted, by laws which establish policies, procedures, or rules in personnel matters.

Particularly, I want to emphasize my conviction that militant tactics have no place in the functions of any organization of Government employees. Upon employees in the Federal service rests the obligation to serve the whole people, whose interests and welfare require orderliness and continuity in the conduct of Government activities. This obligation is paramount. Since their own services have to do with the functioning of the Government, a strike of public employees manifests nothing less than an intent on their part to prevent or obstruct the operations of Government until their demands are satisfied. Such action, looking toward the paralysis of Government by those who have sworn to support it, is unthinkable and intolerable. It is, therefore, with a feeling of gratification that I have noted in the constitution of the National Federation of Federal Employees the provision that “under no circumstances shall this Federation engage in or support strikes against the United States Government.”

Fifthly, a “Yes on Measure-Z” vote will absolutely hurt families and seniors on fixed incomes.  The City of Riverside’s median household income is $56,000.00  This amount has yet to recover from “pre-recessions highs,” thus causing financial uncertainty for families.  Taking it a step further, Retirees Social Security household income averages $16,000.00

Sixthly, If Measure-Z passes, a single consumer will pay $250.00 dollars more in addition to the $2000.00 in taxes for the cost of a $25,000.00 vehicle!

Seventhly, Verify the Facts, go to the City of Riverside website  www.riversideca.gov/measurez    You will find two videos that should be watched on why the City would like to vote Yes on Measure-Z, there is also a Q & A on Yes on Measure-Z, a report on Budget Facts, City Manager John Russo’s letter in For Year 2016-2018 Biennial Budget.  Is Russo thinking that he should have retired and just have bought that pizza joint in the Bronx?

Is Councilmember John Burnard and his long time friend Laura Densmore waiting on the sidelines wanting Campaign contributions and equestrian trails at the expense of the public? Will John sell out the taxpaying public and his constituents for Horse Trails?

I see this as political suicide for council member John Burnard. He has only been a council member for a short period of time and has made some critical mistakes. Common sense “dumb” mistakes , for example, asking the city Manager’s office to lift the stop work order on Ag park so Cox Construction can put the Jurupa road through. Did Burnard realize that the land is so toxic it could or has made people very sick and any one working on the property could possibly DIE! Also Supporting his long time friend former Council member Laura Densmore and local Attorney Virginia Blumenthal on the re- hashing of old wounds , another proposed development on the Protected Lands of La Sierra Hills. I personally cannot believe Virginia is supporting this issue or even involved in this fiasco. Going down this rocky road will be a fiasco and I’m sure will turn out vile. There has got to be some reason she is involved?  IT makes NO sense…. The public and many of John’s supporters are definitely turning on him, feeling the pain of that rusty knife in their back.

On Wednesday, November 4th Council member Burnard conducted a meeting in Ward 7 concerning the La Sierra River Ranch and Hills. The majority of Riverside citizens have been fighting to protect this land for 38 years. The land protecting initiatives were known as Measure C and Proposition R, and now Measure L will challenge it. The fight for this land has been on the ballot at least 8 times since 1977. Last night’s meeting was to introduce a new development plan and attempt to get the public behind it by the guise of public input. There were approximately 100 people there. Any time 100 people show up to a community meeting, the issue is HOT…… It was a barn burner of an event.

The Passion or should I say distain for this new plan was indisputable. The distrust still remains high for the Las Vegas developer, the wounds are still fresh from the last recent fight at the ballot box with Measure L. The meeting started out with Laura, Ken and Virginia trying to convince the audience that they reached out to the developer to down size the project from 1900 homes to 725 homes and to include the equestrian trails John Burnard and Laura Densmore so desperately want. Virginia stated that she campaigned hard against Measure L and she knew the issue would keep coming up. Virginia stated she believed it would be better if the public, or her little group of 3 community folks, had control over the project. She also stated there was no monetary gain for her support of this new plan.

The public then gets to weigh in, a woman from Norco expresses concern about the traffic. Other’s asked why does the city feel the need to develop every inch of the green belt. We are sick of the deceit. One said, “City should buy the land.” One asked, “Where’s the developer ? “SAVE THE HILLS?” He (developer) lied and misrepresented Measure L. This Man cannot be trusted, it’s a matter of principal.” Another, “Where are you going to build the post office, fire and police station, and grocery store?” Another, “No walking trails, no commercial area.  Aren’t we in a drought, where’s the extra water coming from?” Former Interim Councilman and Riverside Planning Director, Ken Gutierrez attempted to answer most of the questions, but the mumbo jumbo that came from his mouth was enough for most to see the deception. It was a “Cluster Fox Trot!

There was only one supporter in the audience, can you guess who that was. Frank Coral AKA Union. “Change is hard but change is good.” “We don’t go to Murrieta and tell them how to run their city”. “Norco shouldn’t tell us how to run ours.” Maybe Frank didn’t get the memo from City manager, John Russo’s office stating we need to be a regional city and we should be respectful to our neighbors. As a matter of fact I was at Murrieta’s City council meeting Tuesday night changing their public decorum policy.

The most shocking moment of the evening came when someone from the audience stated. “ Why wasn’t Sharon Mateja invited to be on the new committee.” INTERESTING……

Who is Sharon? Sharon has made a commitment and investment to her community and our city, she spends countless hours preparing information and getting speakers for the Residents for Responsible Representation (RRR) community group. When The La Sierra Hills lands were being challenged last year she was opposed and worked tirelesssly along with Laura Densmore and John Burnard to defeat Measure L . Sharon and others believed the lands would be challenged again and they wanted to be prepared. Sharon reached out to Laura to get a new committee started, Laura told Sharon she wasn’t ready to start a new committee yet. Sharon reached out a second time to Laura, Laura told Sharon she had already started a new committee. Sharon asked to be on the new committee and Laura told her NO! “NO we don’t want you on the new Committee.” They also left Mary Humboldt and Bob Buster out.

You have to ask yourself why this little self appointed group of 3 Ken, Laura and Virginia didn’t want Sharon to be on this new committee? How did they decide that they would take the reins and negotiate in favor of the community with the developer? ARE THESE 3 PEOPLE KIDDING? Now they have created distrust, suspicion and contempt, not only for the new proposed project but for the new little committee.  Developers need to be lobbied in order to come to invest in ones City.  A self appointed community group, who strategically left those out that were not supportive, bring the issue of development to the community they claim to represent.  See the picture folks.  Also showing their faces was Councilman Jim Perry and Assistant City Manager Alex Nguyen, both who simply observed and said nothing.

No EIR as well?  According to former Planning Director/ interim Councilman Ken Gutierrez…Don’t need one! But the City of Riverside was quick to want to sue the City of Moreno with regards to the World Logistics Center as a result of an EIR (Environmental Impact Report).  Isn’t Barnyard selling out to those who voted him in? He was against development of the La Sierra Hills area, now he is? Well he did campaign that he would like to see more horse trails.

The fact that last night’s meeting was “hosted” by Council member Burnard to help the developer, Terry Manley, “work” with “the community” was of concern to those of us who’ve been through these kinds of battles between residents and their so-called “representatives.” Even more notable was that only political insiders — like Laura Pearson Densmore, Virginia Blumenthal and Ken Gutierrez — were on the self-appointed ad hoc committee to “negotiate” with the developer. Then the bombshell of the evening came when it was revealed that Ms. Pearson Densmore had intentionally and studiously avoided including other members of the NO on L committee as former County Supervisor Bob Buster, Mary Humboldt and Dr. Sharon Mateja D.D.S, in the new committee working with the developer.  – Letitia Pepper, commenter on the PE.

If you recall, the last time this issue came to the forefront, Las Vegas developer Terry Manley was involved, but so was local favorite, Chuck Cox and billionaire associate from Santa Barbara Bill Davis under the auspices of the New West Company.

Also, former Councilwoman Nancy Hart, former Mayor Ron Loveridge and BB&K attorney George Reyes was involved. This whole arrangement was closely connected with the City of Riverside.

If you think the City of Bell had serious taxation problems and mis-appropriation of funds, if you were shocked by the posting on electric rates, grab your socks again, and you may want to grab everbody else’s!  Every city’s doin it! Is what’s being said…but it looks as if the people are taking the upper hand on this, or as Charley Sheen would say, “Winning”!  For example, the City of Fullerton.

Or in this article in the Orange County Register questioning $27 million in illegal water fees..  And of course challenging Fullerton’s illegal water tax as in this article.  And again, more on the City of Fullerton and illegal water rate increases.  But onward, let’s look at the City of Riverside.

Riverside levies hidden taxes on your utility bill.  They are simply and stealthily included in the utility rates the city charges residential customers.  Your minimum tax rate on water and electric utility services to your property is 11.5%.   It expands upward from there depending on how much utility service you use that is subject to punitive tiered pricing.

Let us look at your bill for water and the city’s wa-1 residential winter water rate schedule.  The first tier or the base metered rate for water service is $1.13 per ccf (this is the metered unit of measure for water service and is 100 cubic feet of water).   The base rate is charged to the consumption of each of the first 15 ccf of water service each month.   On a per ccf basis $0.13 of the first tier rate per ccf is tax revenue paid to the general fund.  That is a tax rate of 11.5%.

Should you exceed first tier usage as most homeowners do then, you are charged at the second tier price of $1.64 per ccf from the 16th thru the 35 th ccf of service.   The difference of $0.51 per ccf in the second tier water rate is an additional tax for using more water service than the city thinks you should.  It is a punitive tax to economically force you the consumer to conserve water.   You are being taxed even though you are using water for beneficial purposes and not wasting water.   Looking at just the $0.51 price difference per ccf of first tier and second tier ccfs the effective tax rate is 39%!

Should you use more than 35 ccf of water service per month you are billed at the 3rd tier rate of $2.26 per ccf for those units consumed from the 36th thru the 60 th ccf.   The third tier tax is $1.26 per ccf.  This is an effective tax rate of 56%!

Now, if you are a big-time water waster according to the city, you pay the fourth tier rate of $2.75 per ccf for any ccfs consumed over 60 ccf per month.   The price difference from the 1st tier is $1.62 per ccf and the 4th tier effective tax rate is 64%!!   Now that’s a punitive tax!

 

If this really bothers you, wait until the summer rates kick in on your June billing.

Residential water rate schedule wa-1 summer.

1st tier 0-15 ccf      $1.14       your tax rate=11.5%

2nd tier 16-35 ccf   $1.83       your tax rate=44%

3rd tier  36-60 ccf   $2.85      your tax rate=64%

4th tier  >60ccf        $4.10      your tax rate=75%

To help put this into perspective with how our water is produced by pumping wells and the fact that Riverside does not buy expensive imported water please review the following facts:

  • Water production is measured in acre feet of water.  That is enough water to stand 12 inches deep on one acre of land.
  • A ccf is water  your city water meter records as you consume water service.  A ccf is one hundred cubic feet of water.   There are 436 ccfs in an acre foot of water.
  • Imported water from northern California or the Colorado River is priced between $550-800 per acre foot.  According to Dave Wright, the city does not buy imported water.   Dave also says, we are water independent even during the statewide drought of recent years.
  • The city’s cost to provide ground water to you is less than $300 per acre foot.   That calculates to $0.68 per ccf at your meter.  They do need some funds to maintain the infrastructure (the extra $0.32 ??).
  • At the city’s summer 1st tier rate of $1.15 per ccf , you are paying $500 per acre foot of water at your meter. 
  • At the city’s 2nd tier summer rate of $1.83 per ccf, you are paying $800 per acre foot of water at your meter. 
  • At the city’s 3rd tier summer rate of $2.85 per ccf, you are paying $1,243.00 per acre foot of water.
  • At the city’s 4th tier summer rate of $4.10 per ccf, you are paying $1,788.00 per acre foot of water.
  • A municipal utility is not allowed to make money.  It is a government owned monopoly and may not charge more than the actual cost of providing the service to you at your property.  They are budgeted to break even.  They have reserve funds in case of a bad year and the City can always make a loan or spend other tax revenue to cover an annual loss.
  • In recent years the city has taken no steps to reduce costs of operating its’ utilities.  They have taken every opportunity to expand the cost to residential consumers.
  • The water utility has a huge fixed annual cost (mostly debt payments) averaged over the calculated water rates and total annual production.  It must sell all of its planned annual production to recoup the funds needed to pay the bills.  If you are forced to conserve water, the city has to automatically raise the price.  It is the Math!
  • The city makes more money by transfers to the general fund with every rate increase!  A city general fund may only receive tax revenue.

Now that is some profit margin of hidden taxes!  Where is your money going?  I hope you can live on 15 ccf of water service per month!!

Remember the City Municipal Code requires all property owners to landscape, irrigate, mow, trim and weed all portions of their property that faces a public street or right of way.  Code enforcement may issue you a citation and a fine of up to $1000.00 per day and/or prosecution of a misdemeanor for failing to adequately water your front yard!  If you fail to comply with Code enforcement a lien for the fines will be placed on your property and the city will enforce the lien and auction your house on the court house steps to satisfy the lien.   See Municipal Code Chapter 6.14.

Most residential properties in the city have a right to a water allotment equal to the annual amount originally supplied to your land by any of the original water companies that first supplied water to your property via canal, ditch or pipes (Cal. Supreme, A.O. Price v. The Riverside Land & Irrigation Co. , 1880).  Historical records indicate you may have a right of up to 10 acre feet of water supply per acre of land per year.  In the Supreme Courts words, “the water is welded to the land as a permanent right to the same level of water service as originally provided,  … it cannot be separated or sold from the land by the water company or the land owner or owners of either in succession.”  You are the current landowner in succession and the city is the current water company owner in succession.  This is a right to water, “the water stays with the land in perpetuity.”  This is the legal reason the City must sell 18% of its water production each year to areas outside the city in Home Gardens and Corona (but the city won’t tell you this).

The city by approving 50% increases in water rates over the last six years and instituting punitive tiered pricing is forcing you to conserve water you are entitled to use beneficially on your property (October 2006, city council approved rate hikes and tiered pricing to fund the “$1.5 billion Renaissance”).  This burden of hidden taxation falls most harshly on fixed income (retirees) and low income families in the city.

I believe her claims.There’s a reason why over the years, those in office use the same construction firms, law firms, management firms, environmental firms and so on..they know people in those business so when they get “approved” for their services, the price is millions over the cost than it should be so each side makes a profit under the table..on our dime..but yet..city services are struggling to make ends meet. perhaps if they take a look at their dirty deeds and wasteful/corrupt spending and bilking and quit looking toward us to pay for their actions, they would have money to pay the paychecks and their bills instead of using the guise of “the money just isn’t there”..it’s there buried under “official accounts” for various services that don’t exist.  – Navyguyhm3, commenter on the PE.
